HC: Domestic Violence Act can be used with retrospective effect

Mar 23, 2010

NEW DELHI: In an important ruling, the Delhi high court has clarified that the Domestic Violence Act has a retrospective effect. This means it can be invoked even by women who were subjected to domestic violence before the Act came into force in October 2006.

Justice V K Jain, while dealing with a complaint filed under the Domestic Violence Act, said the Act was maintainable ''even if the domestic violence has been committed prior to coming into force of the Act.'''

Setting aside the order by a lower court, justice Jain further observed, ''The court needs to eschew from taking an interpretation which would not only be violative of constitutional rights but would also result in denying the benefit of the beneficial provisions of the Act to the women who have been subjected to domestic violence and are compelled to live separately on account of a man's acts of omission or commission. Such an interpretation would at least partially defeat the legislative intent behind enactment of this Act, which was to protect women against domestic violence, to give them compensation and other suitable reliefs.''

HC was hearing a petition filed by a woman appealing against the order of a lower court. The petitioner alleged she was forced to leave the matrimonial home because of her husband's behaviour. While the magistrate allowed her plea and granted maintenance of Rs 6,000 per month to her, the husband appealed against it. A court held that the victim was not entitled to any relief under the DV Act because she had left the matrimonial home in 2005 while the Act came into force a year later.

lex retro non agit or is it ? in reference to Domestic Violence Act, 2005
Are Laws with penal consequences susceptible to retrospective application ?…the answer is in negative for reasons more than one, the essentiality of a right of protection from laws with retrospective application is accepted without argument, in light of well established judicially professed maxim “Nullum crimen, nulla poena sine praevia lege poenali” which when translated means ‘No crime, no punishment without a previous penal law” a principle devised & appearing first, way back in 1789 and widely accepted by civilized jurisdictions around the world, recognizing that - making an act, a crime retrospectively after it is done is prime facie of questionable policy and contrary to the general principle that legislation by which the conduct of mankind is to be regulated ought…. to deal with future acts and ought not to change the character of past transactions carried on upon the faith of the then existing law…” [3] and furthermore the history is devoid of any justification for the same, & the same bears testimony to the fact that whenever force has been given to such laws, it has resulted in gross miscarriage of justice.

An ex post facto law or retroactive law, is a law that retroactively changes the legal consequences (or status) of actions committed or relationships that existed prior to the enactment of the law. In reference to criminal law, it may criminalize actions that were legal when committed; or it may aggravate a crime by bringing it into a more severe category than it was in at the time it was committed; or it may change or increase the punishment prescribed for a crime, such as by adding new penalties or extending terms; or it may alter the rules of evidence in order to make conviction for a crime more likely than it would have been at the time of the action for which a defendant is prosecuted.

Nevertheless, there are several examples in international, Australian and British law where the principle has been ignored or at least circumvented. The question of retrospectivity of penal legislations NOW assumes immense importance, in the wake of recent Delhi High Court judgment, purporting to render Domestic Violence Act – ex-post-facto and apply it retrospectively, which has breathed a new lease of life into the dying debate.

Leaders, Human Rights Activists & Legislators over the world have expressed scorn over such laws. Australian Prime Minister Howard ‘commented condemning retrospective criminal laws. "It's fundamentally wrong to make a criminal law retrospective," he told a television reporter, "We don't support that and won't support that," said the Prime Minister.

The stand of the Prime Minister is to be commended. The Basic edict of the International Bill of Rights i.e The Universal Declaration of Human Rights vide Article 11 provides that a person should be sentenced under the law in force at the time of the crimes he or she committed. To sentence a person under a later regime is to shift the goalposts in a way that contravenes every principle of due process in the criminal justice system.

Sounding fierce dissent over the use of such laws, Thomas Jefferson, in his Letter to Isaac McPherson, way back in August 13, 1813 said “The sentiment that ex post facto laws are against natural right is so strong in the United States, that few, if any, of the State constitutions have failed to proscribe them. The federal constitution indeed interdicts them in criminal cases only; but they are equally unjust in civil as in criminal cases, and the omission of a caution which would have been right, does not justify the doing what is wrong. Nor ought it to be presumed that the legislature meant to use a phrase in an unjustifiable sense, if by rules of construction it can be ever strained to what is just."

Now proceeding with the premise of general acceptance over existence of such right against retrospective laws, and abhorrence over such laws, what needs to be seen is weather the right to protection from retroactive criminal law an absolute human right, or should its application be qualified by reference to the circumstances in each case? Clearly, & in light of examples we have seen in the form of Nuremberg Trials and others, we can say that the right to protection from retroactive criminal law is not an absolute human right.

But if it is a qualified human right, what are the conditions that must be fulfilled before that right will be restricted?. Even if immorality is a necessary condition, it is clearly not sufficient to qualify the right to protection from retroactive criminal law, before pondering over such questions, heres a brief history of retrospectivity of penal legislations.

History of Law Against Ex-Post Facto Legislations.
From the nullum crimen maxim, discussed above jurists have deduced the principle of prohibition of retrospective penal laws. As early as 1651, Hobbes wrote: No law, made after a fact done, can make it a crime ... For before the law, there is no transgression of the law.2

This principle was stated in 1789 in Article 1, section 9(3) of the American Constitution which prohibited ex post facto laws. Article 7 of the European Convention on Human Rights provides that no one shall be held guilty of a penal offence made so retrospectively. Article 7 includes the important proviso that it:

... shall not prejudice the trial and punishment of any person for any act or omission which, at the time when it was committed, was criminal according to the general principles of law recognised by civilized nations.

Article 15 of the International Covenant on Civil and Political Rights states, inter alia:

No one shall be held guilty of any criminal offence on account of any act or omission which did not constitute a criminal offence, under national or international law, at the time when it was committed.

In India without using the expression "Ex post facto law" the underlying principle has been adopted in the Article 20 (1) of the Indian Constitution in the following words:

"No person shall be convicted of any offence except for violation of a law in force at the time of the commission of the act charged as an offence, nor be subjected to a penalty greater than that which have been inflicted under the law in force at the time of commission of the offence."

Hence it is quite unanimous that any law that has as any of its consequences, penal repercussions, is to be applied prospectively, departure only to be allowed in rarest of the rare cases, in instances morally repugnant or involving grave moral turpitude.

In Reference to the recent pronouncement of the Delhi High Court apropos Domestic Violence Act, 2005

In light of above well established principles it can be said, that in the context of the criminal law, a person should only be convicted and punished on the basis of law. An individual must know in advance what acts and omissions will make him/her liable to prosecution and the rule is regarded as being of particular importance in the sphere of criminal justice.

Marking a distinct departure from the principle of lex retro non agit[4] & other rulings of district courts in this behalf, which ruled that if the alleged acts of domestic violence have occurred before the act was notified, they would not be entertained by the protection officers, the judgment in question[5] adopts a beneficial construction/interpretation, and held that legislative intent of providing succor to women who are harassed at the hands of their husbands and their in-laws, should be taken into consideration whenever construing/interpreting the act, but the Hon’ble Court failed to recognize that this kind of interpretation runs contrary to all established norms of fairness & no justification/rationale could justify a concept as legally unsound as this.

The Hon’ble Court in its portentous judgment delivered on 22nd March, 2010[6], while dealing with a complaint filed under the Domestic Violence Act, said the Act was maintainable ‘‘even if the domestic violence has been committed prior to coming into force of the Act.’’' The Court based its ratio on the principle of construing the act keeping in view the legislative intent behind it, but it failed to take into consideration that if the legislature indeed desired or infact intended the act to have a retrospective effect, for that matter, it would have provided so expressly.

While raising assumptions & presumptions the Hon’ble Court further went on to say that “There is no difference between the women who were subjected to domestic violence before 2005 and those who were later, as any differentiation would tantamount to denying the right of equality before law guaranteed to all citizens by the Constitution, "Any discriminatory treatment to women in either category would be violative of their constitutional right guaranteed under Article 14 of the Constitution the court held.

But the Hon’ble Court, while trying to concur its judgment with constitutional right to equality, with due respect perhaps forgot that the very basic premise of this act, so far it addresses domestic violence only if it is perpetuated by a Male Partner, is violative of Article 14 on the very face of it, especially in light of various studies which put it beyond reasonable doubt that even women are capable of inflicting violence in domestic relationships.

The Advocates of this judgment may raise an argument or perhaps the only one, can be that as the act does not primarily envisage criminal prosecution & the remedies are essentially civil in nature, hence is outside the purview of ex-post facto law & resultantly not covered by the principle against retrospective criminal laws, but the said argument is I am afraid to say is a little too farfetched, as S.31 of the said act, clearly provides for penal action in case protection orders are disregarded.

Conclusion
The right to protection from retroactive criminal law is well recognised throughout the international community. Yet there are many examples, in communities which claim to espouse this right as being fundamental, where retroactive criminal laws have been made, the example of application of retrospective laws, though very far & few in between, have met great disapproval & censure from all civilized sections of society.

The Court in the instant judgment has shown a willingness to adopt a retributive approach to punishment and to punish retrospectively, and reflects how a rule as basic as this, relating to retrospectivity can be circumvented in the garb of Protection to Women, and runs contrary to various international instruments to that effect & Article 20(1) of the Constitution of India. Lots of reservations have been & continue to be raised as to the soundness of this Particular Legislation, as to the slackness of the drafting of the said act is concerned, and its misuse therof; and the present judgment would do nothing but to help & further the misuse of these provisions, which can prove out to be terribly retrogressive, especially when a lot of hue & cry, albeit justified, is being raised by men activists for a gender neutral domestic violence law.

Date of institution: 29.5.2010

Arguments heard on: 16.8.2010

Date of Decision: 28.8.2010

ORDER:

This revision has been filed against the summoning

orders dated 24.2.2010, 25.3.2010 and 23.4.2010 passed by the

Ld. Trial Court in the petition filed by the respondent Nidhi

Kashyap under Section 12 of the Protection of Women from

Domestic Violence Act, 2005. The revisionist no.1 Smt.

Santosh Kaur is the mother-in-law of the respondent whereas the

revisionist no.2 Ms. Ritu Kashyap is her unmarried sister-in-law

(Nanand) and respondent no.3 Mrs. Sarika Mehta is her married

sister-in-law (Nanand).

Briefly the case of the respondent Nidhi Kashyap/

applicant before the Trial Court is that she was the class mate of

revisionist no.2 Ritu Kashyap who is the real sister of Gaurav

Kashyap (respondent no.1 before the Ld. Trial Court) and had

friendly relations with him. According to Nidhi Kashyap, her

father is a property dealer and mother is a bank employee and

they have strong a financial background. It is pleaded that they

are only two sisters and therefore as a part of well planned

conspiracy, the revisionists before this court induced her to enter

into a matrimonial relationship with Gaurav Kashyap despite the

fact that both belonged to different communities. According to

the respondent, her marriage with Gaurav Kashyap was

solemnized secretly on 29.7.2008 at Arya Samaj Mandir, Birla

Line, Kamla Nagar, Delhi according to Hindu rites and

ceremonies after which she left for her parental home as she was

asked to disclose the factum of her marriage to them only after

45 days. It is further pleaded by Nidhi Kashyap that on

12.9.2008 when she entered into her matrimonial home at 6-D,

Janta Flats, Satyawati Colony, behind Laxmi Bai College, Ashok

Vihar, Phase-III, Delhi the revisionists before this court, under a

well planned design conspiracy and in a pre planned manner,

called her parents at their home and disclosed the factum of the

marriage of their son with the present respondent (Nidhi

Kashyap) on which her parents received a serious shock but

finding no alternative they ultimately gave their consent and

approval to the matrimonial ties and on 12.10.2008 as per the

demands of her in-laws, her parents organized a joint reception

where they gave a large amount of gold and jewellery and

domestic articles and cash to her. According to Nidhi Kashyap,

the respondent before this court court, the revisionists are in

domestic relationship with her due to her matrimonial

relationship with Gaurav Kashyap (respondent no. 1 before the

Ld. Trial Court). She has alleged that on 13.10.2008 after she

entered into her matrimonial home, her Nanand the revisionist

no.2 Ritu Kashyap raised a demand of Hundai i10 car and it was

made clear to her that in case if she wants to live peacefully she

would have to ask her parents to satisfy their demands. Again on

13.10.2008, her mother-in-law Smt. Santosh Kashyap the

revisionist no.1 before this court took a sum of Rs.20,000/- from

her purse against her will and consent and in the evening the

revisionists no.2 and 3 took away entire gold and diamond

jewelleries except one Mangal Sutra, one gold ring, nose pin

and ear rings and thereafter did not return the same to her despite

her repeated requests and demands. The present respondent

Nidhi Kashyap has also mentioned numerous other occasions

alleging that the revisionists before this court had been

disclosing their intent and expectations for cash and other

articles from time to time and she had been subjected to

harassment, torture and violence on account of the repeated

dowry demands made by the revisionists before this court

including her married sister-in-law Sarika Mehta. According to

Nidhi Kashyap, her entire jewellery is lying with her in-laws. A

petition under Section 9 of the Hindu Marriage Act filed by

Gaurav Kashyap the husband of the present respondent is also

pending adjudication before the Ld. ADJ, Rohini. She has

alleged that she has been compelled to make a complaint before

the Crime Against Women Cell, Pitam Pura, Delhi on account of

the callous conduct on the part of her in-laws including the

present revisionists. She has further alleged that her husband

Gaurav Kashyap is the owner of property bearing no. 6-D, Janta

Flats, Satyawati Colony, Behind Laxmi Bai College, Ashok

Vihar, Phase-III, Delhi and he and his parents are owning and

possessing 100 sq. plot as Samaipur Badli, Delhi. Further, she

has alleged that her husband Gaurav Kashyap and his parents are

owning and possessing the HIG Flat in TDI Sonepat having a

market value to the tune of Rs.22 lacs and are running a factory

under the name and style of MCO Chemical, Samaypur, Delhi

and are owning and possessing two godowns at Samaypur and

Swaroop Nagar and her husband Gaurav Kashyap is having one

house at Sri Nagar, Bharat Nagar, Delhi. It is also alleged by the

respondent before this court that her husband and his parents are

owning and possessing a Maruti 800 car bearing no. DL-6019

and are also owning a truck Tata-407 and two victor bikes. She

has now demanded that her husband Gaurav Kashyap i.e. the

respondent no.1 before the Ld. Trial Court is under a legal

obligation to maintain her and she requires independent

residential accommodation which is available at the rental value

of Rs.10,000/- per month excluding the water and electricity

charges and also requires Rs.30,000/- per month for her

maintenance and Rs. 5 lacs on account of mental torture, pain

and agony suffered by her. According to the present respondent

she cannot remain dependent upon her parents for her shelter and

therefore, her husband Gaurav Kashyap is required to make the

arrangements for separate residential accommodation. In her

petition, the present respondent Nidhi Kashyap has further

demanded that her husband and her in-laws including the present

revisionists should be restrained from entering into her parental

home and from making any kind of communication to her and

from committing any act of Domestic Violence and aiding or

abetting in the commission of acts of domestic violence.

Further, she has demanded that they be restrained from

alienating and parting with her istridhan articles and also from

creating any third part interest and parting with the possession of

the property bearing No. D-6, Janta Flats, Satyawati Colony,

Behind Laxmi Bai College, Ashok Vihar, Delhi and property

bearing no. 77, Bharat Nagar Delhi till her husband make the

provisions for her independent residential accommodation. She

has also claimed Rs.3,000/- from her in-laws including the

present revisionists as litigation expenses.

Pursuant to the aforesaid petition, the Ld. Trial Court

sought a Domestic Incident Report from the Protection Officer.

The said report was duly filed which I have duly perused. The

said report clearly reflects that Smt. Sarika Mehta the revisionist

no.3 before this court is not a member of the shared household

and is separately residing at her matrimonial home residing at F-

8, 2nd Floor, Kamla Nagar, Delhi with her husband Sh. Kamal

Mehta whereas Smt. Santosh Kaur the mother-in-law and Ritu

Kashyap the unmarried sister-in-law are all residing at 6-D, Janta

Flats, Satyawati Colony, Behind Laxmi Bai College, Delhi. The

report further shows that only one incident of domestic violence

on 3.7.2009 by the husband has been reported on which day the

present respondent was beaten by her husband and was asked to

leave the house. The report further reflects that the only incident

of verbal and emotional abuse are of insults for not having

brought dowry, demeaning, humiliating, undermining, ridicule

and name calling by her husband and her in-laws and preventing

her from meeting a particular person. She has also alleged

economic violence upon her by her husband by not providing her

money, food, clothes, medicine etc. and forcing her out of the

matrimonial house and has alleged that her in-laws including the

present revisionists have disposed off her istridhan articles by

selling or pawing the same without her consent and forcibly

taken away her salary, income or wages etc.

The revisionists before this court have alleged that

the orders of summoning are also bad as they have been passed

without calling upon the respondent to furnish and establish the

material facts necessitated for passing such orders. It is

submitted that no domestic violence has ever been committed by

the revisionists upon the respondent before this court

(complainant before the Ld. Trial Court) and the petitioner under

the Domestic Violence Act has been filed on false and frivolous

grounds and the complaint filed by the present respondents

against them before Crime Against Women Cell, Pitam Pura has

been filed only to harass, humiliate and to extort money from

them. The revisionists have pointed out that the marriage of

Gaurav Kashyap with the present respondent was a simple one

without any demand and was an outcome of the love affair.

They have pointed out that the parents of the present respondent

were against her marriage and therefore, they secretly got

married without informing their family members at Arya Samaj

Mandir which was a dowry less marriage and the respondent had

come in wearing clothes and it is in this background that the

parents of Gaurav Kashyap including the revisionists organized a

reception on 12.10.2008 at Janak Vatika, Bharat Nagar. The

revisionists have further pointed out that on 3.7.2009 the present

respondent Nidhi Kashyap picked up a quarrel with her husband

Gaurav Kashyap and called her father with 5-6 other people who

beaten up Gaurav Kashyap and even shouted on road and use

abusive language for Gaurav Kashyap. Thereafter the present

respondent went to her parent's house by saying that she would

not live nor would maintain any relations with them and Gaurav

Kashyap made umpteen efforts to bring her back but she refused.

According to the revisionists they are themselves aggrieved and

victim of the violence inflicted upon them by the present

respondent. It is further stated that all the properties mentioned

by the present respondent does not belong to the husband of the

respondent. The revisionists have placed their reliance on the

following authorities:

1. S.R. Batra & Anr. vs. Smt. Taruna Batra reported in 1

(2007) SLT 1.

2. Shumita Didi Sandhu Vs. Sanjay Singh Sandhu reported

in 2007 (96) DRJ 697.

3. Mohd. Maqeenuddin Ahmed & Ors. Vs. The State of

Andhra Pradesh & Anr. reported in 2008 (1) JCC 85.

The Protection of Women from Domestic Violence

Act, 2005 is a special legislation in favour of women. It is the

duty of the court to ensure that this special legislation reaches

out to the effected lot but at the same time is not allowed to be

misused by anyone.

Wikipedia defines domestic relationship between

two individuals as a legal or personal relationship to live

together or share one domestic life but are neither joined by

marriage nor the civil union.

The Indian law i.e. Protection of Women from

Domestic Violence Act, 2005 does not define family but it

defines Domestic Relationship between two persons who live or

have, at any point of time, lived together in a shared household,

when they are related by consanguinity, marriage or through a

relationship in the nature of marriage, adoption or are family

members living together as a joint family. Domestic relations

are meant to cover sisters, widows, mothers and daughters and

single women. The Indian law does not specify separate

relationship and mentions members in a joint family.

The intent of Protection of Women from Domestic

Violence Act, 2005 is to protect the value system and institution

of family and save it from destruction. This being so, the

provisions of the Protection of Women from Domestic Violence

Act, 2005 have to be so interpreted to ensure that the existing

family system is preserved. The misuse and abuse of the Act is a

matter of serious concern for the courts who are required to be

careful and ensure that a woman petitioner is not made a puppet

or pawn in the hands of her male relatives so as to manipulate

the Protection of Women from Domestic Violence Act, 2005

and use it for ulterior motives.

In the present case it is an admitted case of the parties

before this court that the respondent Nidhi Kashyap who is the

wife of Gaurav Kashyap (respondent no.1 before the Ld. Trial

Court) has filed the complaint under special legislation

(Protection of Women from Domestic Violence Act, 2005)

wherein she has spared none and roped the entire family

including the young unmarried sister-in-law who was her friend

and class-mate even before her marriage and also her married

sister-in-law who is residing separately with her own family. It

is admitted that the marriage between the present respondent

Nidhi Kashyap with Gaurav Kashyap was solemnized secretly

and was an outcome of a love affair as Nidhi Kashyap was

known to Gaurav Kashyap through the revisionist no.2 Ritu

Kashyap who was the batch mate of Nidhi Kashyap and was

studying with her. It is also an admitted case of the parties that

on having come to know of marriage a reception had been

organized after which the present respondent Nidhi Kashyap

started staying with her husband and her in-laws. It appears that

unfortunately the said marriage is not worked out resulting into

spade of litigation between the parties and Gaurav Kashyap even

filed a petition under Section 9 of the Hindu Marriage act

which is still pending adjudication and the present respondent

Nidhi Kashyap has filed a case in Crime Against Women Cell

alleging dowry demands and harassment against one and all.

The provisions of the Protection of Women from

Domestic Violence Act, 2005 have been invoked by the

respondent Nidhi Kashyap not only against her husband Gaurav

Kashyap but also against her aged father-in-law Mohan Lal

Kashyap (respondent no.2 before the Ld. Trial Court), motherin-

law Smt. Santosh Kaur (present revisionist no.1 before this

court), unmarried sister Ritu Kashyap (revisionist no.2 before

this court with whom Nidhi Kashyap was previously studying

and through whom she came to know Gaurav Kashyap and had a

love affair), married sister Smt. Sarika Mehta and her husband

Sh. Kamal Mehta who both are residing at F-8, 2nd Floor, Kala

Nagar, Delhi.

At the very outset I may observe that merely because

the revisionist no.3 Smt. Sarika Mehta happen to be the real

sister of the husband of present respondent would not ipso-facto

imply a domestic relationship to the extent as contemplated

under the Protection of Women from Domestic Violence Act,

2005 as she is residing separately with her own husband and

cannot be deemed to be a member of the shared household as a

joint family. The revisionist no.2 Ritu Kashyap is a young girl

of 22 years who had been the classmate of the present

respondent and through whom the present respondent had came

into contact with Gaurav Kashyap and had an affair culminating

into the marriage. The revisionist no.1 is the aged mother-in-law.

The allegations against her are general and non specific.

Daughters married or unmarried cannot be terrorized

into abandoning their parental family under the fear of their

involvement into litigations connected with Domestic Violence.

Married sisters residing in their own matrimonial houses are not

a part of the shared household or joint family as contemplated

under the Protection of Women from Domestic Violence Act,

2005 but at the same time they have certain rights in their

parental home which cannot be denied to them. Even an

unmarried sister of the husband residing in the shared household

with her parents has certain rights which cannot be taken away.

Making wild allegations against an unmarried sister-in-law of a

tender marriageable age by an estranged wife of brother

tentamounts to inflicting violence upon her and it is the duty of

the court to ensure that she is protected from the same. Violence

can also be inflicted by an estranged wife or daughter-in- law or

sister-in-law upon other members of the husband's family to gain

and secure personal points and financial control or for separating

her husband from his parents and other family members. In the

zeal and endeavour to implement the rights of one woman

(daughter-in- law) it is necessary for the courts to ensure that the

rights of another woman (in her capacity as mother-in-law or

sister-in-law married or unmarried) are not taken away or

infringed in any manner. The Protection of Women from

Domestic Violence Act, 2005 protects the mothers, sisters and

daughters from any kind of physical and mental abuse or

violence in as much as it does the daughter-in- law. The court as

a protector and implementor of rights, is required to perform a

balancing act. It is necessary to ensure that it does not get

swayed by the astute legal drafting of the counsels and is

required to get at the truth of the allegations by examining the

pleadings on the touch-stone of reasonableness and probabilities.

Where a complaint appears to have been filed on filmsy grounds

only to humiliate the family members, the same is required to be

thrown out at the earliest opportunity. Mother-in-law or sister'sin-

law (married or unmarried) cannot be permitted to be

subjected to harassment only because they happen to be related

to the estranged husband of the woman (complainant) .

In the present case firstly I have considered the

allegations reflected in the Domestic Incidence Report and the

allegations so made by the complainant Nidhi Kashyap before

the court which do not inspire confidence and appears to have

been made in routine. The respondent has alleged that the

present revisionists had forcibly taken away her salary and

wages which allegations on the face of it are false and incorrect

since it is an admitted case of the respondent before this court

that she is not working. The question of her husband or in-laws

taking away her salary, income, wages etc. under these

circumstances does not arise.

Secondly the report of the Protection Officer also

show that the dowry related harassment pertains to the demand

of car and cash of Rs.3 lacs. The respondent Nidhi Kashyap has

also attached the list of Stridhan articles alongwith the petition to

support and substantiate her allegations regarding

misappropriation of her Stridhan articles which I have perused. I

may observe that the said list so attached along with the petition

is not a duly authenticated list signed by both the parties as

required under the Dowry Prohibition Act. This is the list of

articles which only the respondent Nidhi Kashyap claims were

her stridhan which list does not bear the signatures of the

respondent. Under the given circumstances as the list is not

signed by both parties, it was necessary for the complainant

Nidhi Kashyap to have attached alongwith her list the receipts/

bills showing purchase of these articles which has not been done.

Therefore, the above allegations also do not appear to be credible

and truth-full particularly keeping in view the background that

the marriage between the respondent and Gaurav Kashyap was a

secret, runaway marriage as an outcome of a love affair which

marriage was kept secret for many days and ultimately when the

same was disclosed to the parents of the respondent by her inlaws

a joint reception was organized.

Thirdly the present respondent Nidhi Kashyap has

not placed on record any document to show that her husband is

the owner of any of the aforesaid properties or have any

independent right over the same. The allegations are non

specific and general. It is settled law that the claim for

alternative accommodation can only be made by a women

against her husband and not against in-laws or other

relatives nor can she claim any right to stay in the said house

(Ref: S.R. Batra & Anr. Vs. Smt. Taruna Batra reported in 1

(2007) SLT 1 and Shumita Didi Sandhu Vs. Sanjay Singh

Sandhu reported in 2007 (96) DRJ 697). The present

respondent has not placed on record any document to show that

the properties in the present case belonging to her husband

Gaurav Kashyap and the complaint in Crime Against Women

Cell.

Lastly it is an admitted case of the parties including

that of the complainant Nidhi Kashyap that her marriage with

Gaurav Kashyap is an outcome of the long standing love affair

between them. She was a classmate of the revisionist no.2 Ritu

Kashyap through whom she was introduced to Gaurav Kashyap

(her real brother) with whom she developed love affair

culminating into a secret marriage which was disclosed to her

parents much later. This being the background of the case, the

allegations made by the complainant against one and all family

members of her husband where none have been spared do not

appear probable. It is apparent on the face of the pleadings that

they have been so drafted so as to involved all the family

members of the husband sparing none including the present

revisionists who are the aged mother-in-law, unmarried sister-inlaw

of marriageable age and married sister-in-law residing

separately. This, it appears has been done for the purpose of

harassing the entire family of the husband with a sinister motive

and design to harass and humiliate them. Given the background

of the case, the allegations made against the Revisionists on the

face of it do not appear to be truthful and probable warranting

any interference from the court under this Special Legislation.

In view of the above background and in the interest

of justice, I hereby set aside the orders of dated 24.2.2010,

25.3.2010 and 23.4.2010 passed by the Ld. Trial Court thereby

summoning the present revisionists i.e. Smt. Santosh Kaur, Ms.

Ritu Kashyap and Smt. Sarika Mehta since there does not exist

sufficient material on record to summon them and to proceed

against them under the Protection of Women from Domestic

Violence Act, 2005.

Revision is accordingly allowed. Trial court record

be sent back along with the copy of this order. Revision file be

consigned to Record Room.

Feminist Tyranny - A US Export to the World

The article has hit the nail on the head, need I say more.Their is a little blurb about India also.

Feminist tyranny refers to government-supported procedures that clearly deny fundamental rights including constitutional due process to men and fathers under the guise of assuring a 'greater good'. That greater good espouses the safety of women and the best interests of the child.

The feminist system is a sham for controlling society. But it's well-funded and well propagandized. This article summarizes the issues of this tyranny, how it has spread and the growing recognition of how it works to destroy society and the rights of fathers.

Feminism was accepted by most as simply fostering equal opportunity for women. So, government-funded programs came into being to promote this.

 The growth of feminist tyranny:

Unfortunately, the money and efforts put into these programs began to support far more than equal opportunity for women. Those in charge found that it opened up an opportunity to direct society in ways that abridged the rights of men and fathers - and their equal rights. Control - not equal opportunity -became their agenda.

Their growing power with government funding allowed perverse changes in the laws - changes that denied the constitutional protection for men and fathers against false accusations. Feminist-instigated government policies and laws view their intentions as a 'greater good' than the rights that keep all of us free. That's the hallmark of tyranny.

A fact of freedom:

There's no greater good than the preservation of your fundamental rights. Those rights include your right to life, liberty, property, self-determination, and your right to parent by direct support and care of your children.
One critical and fundamental right - left to government - is the 'due process' it must adhere to before denying you any fundamental right. In a nutshell, you must have done something seriously wrong and the government - through a trial process with a jury of your peers - must be presented with evidence that's beyond a reasonable doubt for a criminal wrong, or that's clear and convincing for a civil wrong. Not having your 'right to due process' means losing all other rights by a judge's whim.

Feminist propaganda:

But the 'due process' right is precisely what feminist tyranny voids. They invariably propagandize that the safety of women (or best interest of children) needs to take precedence over fundamental and the due process rights of men or fathers. They don't say this precisely, but that's what their efforts have produced.
They also push propaganda about the 'evils' of men and the 'victimhood' of women. It vilifies those it would unjustly persecute while championing those it favors without scrutiny. A convincing propaganda blinds an unwary public to persecution occurring. Nazi propaganda used this approach. As Goebels said, "Just lie enough 'til they believe you".

Feminist tyranny attacks the underbelly of society - the family. Through divorce and the 'new' domestic violence laws, fathers and other men - without the due process to protect the innocent - are thrown out of their family and effectively enslaved to pay for their persecution.

Fathers Rights groups have protested the lack of due process - and lack of equal rights - in divorce and paternity results. But they're easily smothered by the government-subsidized and highly funded women's propaganda machines - and their political clout.

The spreading of the feminist tyranny:

The effectiveness and organization of the feminist system in the U.S. has allowed it to institute Women's Issues-type organizations not only in other countries but into charities and non-governmental organizations (NGOs) that oversee aid and its direction in underdeveloped countries. Their input invariably undermines traditional families in favor of the feminist tyranny model of society.

India protests feminist tyranny:

The feminist tyranny instituted within India's family-related laws has now caused Indian family and men's associations to react to the destruction of rights it causes. These protesting groups recognize the feminist tyranny's system.

They say that under the innocuous guise of women's rights and women's empowerment, radical feminists have systematically destroyed the institutions of family and marriage in most Western countries. They directed their attack at the so-called "developing" nations like India, which is known for its strong family culture and marriage values, and where the only means of social security is the extended family.

The weapons and tactics employed in feminist terrorism are:

 * Hate speech against men and family

* Fabricated and false statistics

* Blatant lies

* Opportunistic arm-twisting, guilt-tripping and bullying

* Draconian gender-biased laws

This feminist system has successfully hijacked the concepts of fairness and equality under law, sabotaged the ideals and goals of democracy, slaughtered human rights and are insisting on a Taliban-like regime in every nation. The fallout of this global gender war is a steep rise in divorce rates, number of fatherless children, violence against men, number of men ending their own lives, number of "unwanted" pregnancies and juvenile crimes.

Feminist terrorism is one of the worst dangers faced by all nations today, and the threat transcends all social, economic and religious barriers. Civilized and respectable citizens of all countries, religions, and socio-economic groups should actively counter such feminist terrorism for the sake of the well-being of our families, communities, our future generations and freedom.

Government's Feminist Tyranny Fosters Matriarchal and State-Run Families

Here is some proof that the Governments in some countries are in the hands of the Feminazi Fascist Witches

Heavy government funding of feminist-based programs has lead to injecting perverse feministic demands by the state into every facet of business, education, and family law. Feminist-demanded privilege especially within family law - referred to as Feminist Jurisprudence - bypasses constitutional protections and common law maxims designed to create freedom and fairness for all.

This article shows how feminist jurisprudence fosters state-run families under matriarchal control and drives fathers from control of their family into slave positions with state-mandated obligations yet no rights.
Our government fosters the growth of fatherless, mother-headed, and truncated families. This trend is endorsed by state laws and benefits. It's implemented through court-ordered destruction of fathers' fundamental rights which results in enslaving fathers to support the government's feminist tyranny. It brings about fathers' disempowerment, absence and destruction. Much of today's youth pathology is a direct result of this.

Custodial vs noncustodial is akin to master vs slave

That state through its family courts is creating a matriarchal society by creating an inequivalent status between fathers and mothers with the destruction of the father-headed family and imposition of a mother-headed family. With feministic jurisprudence dominating our family courts, a dual class system for fathers and mothers is being maintained and strengthened. The two classes are custodial and noncustodial. Having physical custody of the child under divorce or paternity judgments puts you in the custodial class. Mothers are almost invariably assigned custodial status while fit fathers are relegated to a non-custodial status which legally forces a father to pay onerous payments - perhaps a third or more of his gross income - to the mother for whatever use she wishes.

Under divorce and paternity actions, the family court - i.e. the state-assumes virtually permanent control of the family - but most especially of the noncustodial fathers. By unconstitutionally denying a fit father to directly parent (including directly supporting) his children, the state throws a father into the noncustodial status and commences the extortion of money - euphemistically called child support - from him for the mother's arbitrary use of it.

The noncustodial status guarantees not rights and benefits for the father. Visitation or 'sharing in decisions' possibly afforded to him are less than breadcrumbs and easily disregarded by either mother or the court or both. But if he doesn't pay all the child extortion - whether he can or not - he's thrown in jail without a trial with constitutional protections.

Clearly, the state-imposed status of 'non-custodial' on a fit father isn't consistent with that of a free citizen. The mother reaps all rights and benefits associated with the child while incurring no enforced financial responsibility - a 'free' citizen status granted by the state.

Aside from horrendous violations of constitutional rights of the father and the 'equal protection' of the 14th Amendment, the state-imposed termination of a marriage contract of fit parents violates a common equity maxim of fairness: 'he who accrues the benefit bears the burden'. It leaves each parent not in a 'quid pro quo' status but in a custodial v. non-custodial status which is akin to master v. slave status.

Considering the enforced equality in all business and educational settings imposed over the last 30 years, the continuing imposed dual status of custodial (mothers) vs non-custodial (fathers) with its increasingly onerous ramifications to non-custodials reveals that feminist jurisprudence is not interested in equality but in the power to tyrannically dominate men and reform societies fundamental unit, the family, as fundamentally fatherless and mother-headed.

To validate, but obscure, its tyrannical position to the public, the state propagandizes - based on no valid facts - that fathers are willingly running away from both their children and their responsibility to pay for them; and that the state is saving the taxpayers a fortune by forcing these 'irresponsible fathers' to make extortion (child support) payments to the mothers - while of course denying fathers their fundamental right to takeover direct support and parenting of their own children. No fault divorce, a relatively recent invention to more easily allow the destruction of marriage, guarantees divorce at the whim of a mother (or father) which then guarantees her - and overwhelmingly only her - a couple of decades of income, most of the father's assets, and control of his children and his financial impoverishment and often his criminalization. Somehow, no fault divorce really means father are automatically at fault. This state-supported incentive to divorce is destroying fathers along with their families by destroying all their individual constitutional rights, and thereby destroying freedom. With the state instituting restraining orders against fathers that are handed out to women virtually at their whim, like throwing out free candy to them, the state has ensured a quick and easy process to rip fathers from their children, their property, their income, and their constitutional rights, i.e. their fundamental freedoms.

Infidelity and Feminism: Can Cheating Be A Feminist Choice?

October 26, 2009

Written by a feminist academic who had the (dis)pleasure of deliberately
being “the other woman” in an ongoing affair, Cheating on the Sisterhood: Infidelity and Feminism explores her personal struggles as a willing participant in an illicit
relationship that resulted in another woman's devastation, as well as her own. It
is a political look at the motivations that fuel situations of betrayal and the
justifications one provides oneself from the inside.

Since she uses her own life as a jumping off point,
the book is tinged with melodrama and a lack of adequate distance for dispassionate
observation, which certainly makes Cheating
on the Sisterhood
a more interesting read. Researchers are often told to
strive for objectivity in their work; however, she tossed convention
aside in an attempt to engage the reader in her meanderings on depictions of
infidelity in popular culture, the ways women hurt and compete with other
women, feminist rationalizations that allow for denial of culpability, how the
role of “the other woman” reinforces traditional gender roles, the impact of
consumer culture on relationships, and why infidelity is an exercise in sadism,
masochism, and misogyny.
How did you come to
write this book, personally and professionally?
In 2007, I was presenting at a conference near where the man
I discuss in the book lived. I knew seeing him would be emotionally difficult
(he was still living with his partner at that time) and I knew saying goodbye
to him would be worse, so I travelled to see him with the idea that I would
write about my experiences, that when things were bad, I would have 'work' to
fall back on. By nature I am an organizer and I like to—where possible—put in
place infrastructure which minimizes experiences I can predict will provide
horrendously emotional. So I was travelling with books to do preliminary
research and the writing of the book became a strategy (albeit a largely
unsuccessful one!) of distracting me from the emotional torment of being in a
relationship with a man I could never truly be with. I researched and wrote and
edited right through to the end of the relationship.
Professionally the case is much simpler. I am an academic.
Publish or perish is our mantra!
Was it difficult to
divulge personal information that could inculcate negative judgments about your
character or politics?
An assumption I made during the writing of the book—and an
assumption that was only validated, repeatedly, afterwards—was that my
experience was very common. While I expected to experience criticism (which I
received in spades!) the most common response I received from women was that
they had near identical experiences. At books talks and at conferences and
through emails, women have told me about how they felt exactly the same set of
conflicted emotions and faced the same challenges when attempting to manage
their politics.
I'm not ashamed about any of my experiences. I think they're common experiences
and experiences that are worth talking about. I not only own those experiences,
but I own up to them, and if this gets people talking about topics like sexual
politics and feminism, then I happy to take the negative judgments on the chin.
You write this book
from a markedly third wave feminist perspective and challenge feminisms that
are especially dogmatic, yet you do not always hold third wave feminist
ideology in high esteem. What do you see as useful about a third wave approach
to infidelity?
On a very cursory level, supporting women's choices on how
to use their bodies has united each of the branches of feminisms. Yet, while
there might be much agreement on reproductive rights, sexual rights are more
complicated. This is demonstrated by second wave critiques of prostitution, for
example. Third wave feminism has clutched onto choice really, really tightly—and
I like this. I want choice in everything. I want the choice to make both good
and bad decisions. But, as evident in my book, choice on its own is not enough.
If we're going to make our own choices we need to take ownership of those
choices, and we need to understand the consequences. In order for a feminist to
do this with any sense of academic legitimacy, understanding the consequences
of our choices needs to be examined by utilizing all that has been offered by
earlier waves of feminism.
You write that
infidelity is a topic that tends to be cast aside or ignored by the feminist
academy. Why is it necessary to have an explicitly feminist critique of
infidelity?
The 'personal is political' catch cry of feminism reminds us
that the goings on in each of our bedrooms makes for important, and ongoing,
political discussion. We need a feminist critique of infidelity, but of all
sexual practices more broadly. I wrote about infidelity because it was
something I was experiencing and was something that hadn't previously been
examined from a feminist perspective.
What are some of the
most important feminist issues involved in the examination of infidelity?
I think the most important issues a feminist examination of infidelity raises
are the inherent power disparities evident in heterosexual unions and which
ones are exploited in affairs; that the competition between women—notably for
the affections of men—undermines gender equality; and that feminism adds an
additional layer of complication to affairs, which are by their very nature
complicated, often painful, and confusing.
Can you talk about how
feminism is used to justify infidelity?
A third wave feminist take on infidelity focuses on the individual woman and
her rights to sexual pleasure. For this woman, prioritizing her individual
pleasure provides an ability to rationalize her participation in infidelity as
being about the supreme importance of her own sexual pleasure and her shaking
off the shackles of feeling a need to protect the marriage. I am sure there are
cases where feminism has been used to shirk personal responsibility. Personally,
I've used feminism as a way to analyze my behavior, and also as a way to rationalize
it.
Despite the title of
your book, you talk about there not being a true sisterhood to betray and that,
as a result, feminist consciousness will not prevent single women from engaging
in sexual relationships with partnered men or cause them to feel guilty about
it. Can you explain why this is the case?
If no macro sisterhood exists, individual women are not
going to feel loyalties to women who they have no other connection to other
than that they both possess vaginas. When I discussed my own guilt in the book,
that guilt stemmed from knowing that infidelity wasn't a good thing for
feminism. As things progressed I would later feel guilt towards a woman who I
was getting to know (albeit not personally) through being surrounded by her
possessions. In that case, she had an identity, and it's harder to betray
someone when you begin to know them. I don't think a concept of 'sisterhood' is
going to prevent women from acting in their own best interest when everything
else in society works to remind us that there actually isn't a sisterhood.
You write that
feminists should condemn infidelity, yet you remain convinced that you made the
right decision to be involved with a married man. How do you reconcile that?
Ideally, of course, it is in the best interest of feminism
for single women not to get involved with married men—but idealism is a very
different thing from reality. While we can, of course, choose whether we act on
our emotions, individuals make decisions for a suite of reasons, not just
politics. In my case, I made a selfish decision that exploited my own
priorities at that time in my life. Evidently my feminism proved lower down on
that list than some other priorities, like being in an intimate relationship.

The New Art of Alimony

This is the present day form of Slavery for Men. Men today are enslaved to their Ex-Wives for life in certain case.

Long viewed as payment for life, divorce settlements are facing strict new limits as some ex-spouses—primarily men—protest the endless support of a former partner. For richer, for poorer, forever?

Paul and Theresa Taylor were married for 17 years. He was an engineer for Boston's public-works department, while she worked in accounting at a publishing company. They had three children, a weekend cottage on the bay and a house in the suburbs, on a leafy street called Cranberry Lane. In 1982, when they got divorced, the split was amicable. She got the family home; he got the second home. Both agreed "to waive any right to past, present or future alimony."
But recently, more than two decades after the divorce, Ms. Taylor, 64, told a Massachusetts judge she had no job, retirement savings or health insurance. Earlier this year, the judge ordered Mr. Taylor, now 68 and remarried, to pay $400 per week to support his ex-wife.

"This is insane," Mr. Taylor says, adding that the payments cut his after-tax pension by more than one-third. "Someone can just come back 25 years later and say, 'My life went down the toilet, and you're doing good—so now I want some of your money'?"

The nature of marriage has changed dramatically over the decades. Women now make up almost half of the American work force. But alimony, a concept enshrined in ancient law, has remained remarkably constant. Now, the idea that a husband should continue to support his wife forever, even after the demise of their marriage—long a bedrock of divorce law—is being called into question. Pressures are mounting to change a practice that some see as outdated and unfair.

Several U.S. states are battling to place new limits on alimony and rewrite decades-old laws. In Pennsylvania, New Jersey and Oklahoma, lawmakers are pushing for measures like putting time limits on alimony payments, barring alimony if two divorcing spouses are on equal footing professionally, and ending or reducing alimony if the recipient commits a crime or cohabits with another adult in a romantic relationship. Lobbyists and activists are pressing for similar rules in Ohio, Florida, Arizona, Georgia and North Carolina.

In Massachusetts a bill backed by a group called "Reform Massachusetts Alimony Laws Now!" has 72 sponsors and would require a spouse receiving alimony to become self-sufficient, or attempt to, after a reasonable time. That would establish alimony as a temporary payment instead of a permanent entitlement, as is often the case now. A second bill, in the state Senate, would modify the law less radically by adding "duration" to the factors judges can consider when setting alimony payments.

The House bill would end the currently common practice of using the assets of a second spouse to determine the ability of a person to pay alimony. Alimony could only be adjusted upward for cost-of-living increases, and alimony obligations would end upon the retirement of the payer, though judges would still have the flexibility to take into account special circumstances.

State alimony laws, many passed in the 1960s and 1970s, were designed to help nonworking or lesser-earning spouses after divorce. Many states allow for recipients to receive payments for life. Proponents say the money compensates some spouses who have sacrificed careers for families and is particularly vital to low- and middle-income women. Detractors have long called the laws unfair in an age when many women work, with people making payments for years that their former spouses don't really need.

At the core of alimony debate is whether the payments are viewed as transitional—until the dependent spouse gets back on his or her feet—or a long-term dividend for sacrifices made during a marriage.
Now this simmering debate is boiling over. As divorced baby boomers reach retirement age, recession has decimated nest eggs and erased millions of jobs. The American Academy of Matrimonial Lawyers reported a "big spike" this year in clients seeking to modify their alimony arrangements. In a March survey, 42% of the group's divorce attorneys reported an "unusual" increase in such cases, with 6% reporting a drop.
In Los Angeles, Family Court Judge Marjorie Steinberg also reports a "dramatic" surge in these requests. She says petitioners include one-time high earners who've lost their jobs, a group she says she'd "rarely seen before."

The bill in Massachusetts' House of Representatives has gained the support of a group called the 2nd Wives Club. Club co-founder Jeanie Hitner, who is 59 and lives in Marlbourough, Mass., testified to state legislators last month that she is working a second job—tutoring math four nights a week—to help her husband make alimony payments to his first wife.

Ms. Hitner says she wishes she had just stayed his girlfriend. "If I had known about this before we got married, I never would have married him," says Ms. Hitner. Her husband, Steve Hitner, is the head of Reform Massachusetts Alimony Laws Now!, a grass-roots group that consists mostly of alimony-paying men, and supports the same bill. "I don't blame her; I never would have put her through this if I had known what she was going to be in for," Mr. Hitner says.

Opponents of the bill say it may not adequately protect those who rely on alimony payments. Massachusetts State Sen. Cynthia Stone Creem, a Democrat and a divorce lawyer who co-chairs the joint judiciary committee, has called for a commission to study all the alimony legislation, a move that could delay a vote until next summer. Sen. Stone Creem filed her own bill, which would modify the state's law slightly, giving judges greater leeway in setting the duration of alimony payments.

Many states put formal alimony laws into place in the 1960s and 1970s, amid rising divorce rates and concerns that women earned less than men. States such as California and Massachusetts passed laws that included provisions for indefinite alimony. More-conservative Texas, by comparison, generally limited payments to three years.

Many divorce agreements provide for alimony or spouse-support payments, which is separate from child-support payments. Americans gave $9.4 billion to former spouses in 2007, up from $5.6 billion a decade earlier, according to the Internal Revenue Service. Men accounted for 97% of alimony-payers last year, according to the U.S. Census Bureau, although the share of women supporting ex-husbands is on the rise.
Critics argue that in the decades since alimony guidelines were set, the U.S. has changed much: Women made up 46.7% of the work force last year, up from 41.2% in 1978, according to the Department of Labor. Others counter that America hasn't changed enough: Women in the 45-to-54-year-old age group earn 75% as much as men the same age.

But the momentum appears to be with those who seek to guard alimony payers' shrinking resources. Legislation may be gaining traction in part because powerful citizens and lawmakers, themselves divorced, are getting a close-up view of what they see as a flawed alimony system, says retired Judge Robert D. Frank, who handled divorce cases in Tulsa, Okla.

In April, for example, Palm Beach County Circuit Court Judge David French prevailed following a 16-year battle to stop or reduce his alimony payments. A state appeals court ruled that Mr. French should not be forced to pay $3,400 a month to his ex-wife, who has lived for nearly 20 years with another man. The judge ordered the ex-wife to pay Mr. French $151,000, the amount she had received from him since he filed a previous case in 2005. Ms. French's lawyer did not return a call seeking comment. Amy Shield, Mr. French's lawyer, said he was pleased with the decision.

A Florida group has hired a lobbyist to push a bill limiting alimony payments to three years. Ohio's bar association, meanwhile, is lining up legislative sponsors for a bill that could shorten alimony terms—ending support after seven years, for example, following a marriage that lasted 15. Pennsylvania's Senate is considering a bill that could cut alimony to recipients who live in a romantic relationship with another adult.
Last month, Massachusetts representatives heard testimony from Brenda Caggiano, a 70-year-old retired first-grade teacher who supports her ex-husband, Robert, a certified public accountant. When the Caggianos divorced in 2003, they split their assets. He got their home on Cape Cod. She got their home in a Boston suburb, and paid him the $57,000 difference in the value of the homes.

Ms. Caggiano earned more at the time, so the court ordered her to pay $125 in weekly alimony until her death or her former husband's remarriage. Since Massachusetts is a "no-fault" divorce state, it made no difference that it was, as both parties acknowledge, Mr. Caggiano who left home.
Ms. Caggiano says she's living pension-check-to-pension-check and has had to tap a home-equity line of credit to fix her roof. "It's a disgrace that this man is taking my money when he's perfectly capable of supporting himself," she says.

Mr. Caggiano, who is 68, said in an interview he has no mortgage and that his girlfriend, who works full-time, has moved in. He says the couple recently traveled to Italy, and that he spent $60,000 to install hardwood floors, granite countertops and big windows "to get a beautiful view of the water." He keeps his accounting practice to a few clients: "I'm not going out there trying to develop new business."

Asked why he should receive alimony, Mr. Caggiano said he sees it as reimbursement for a time early in their marriage when he paid most expenses, including the down payments on the two homes that were divided at the divorce. Ms. Caggiano says she wants a court to modify her payments but can't afford an attorney.
Another Massachusetts pair, Rudolph and Carneice Pierce, have taken their battle to the state's Supreme Judicial Court. As soon as next month, the court is expected to issue its decision, which could have broad implications for retirement-aged baby boomers.

The Pierces were divorced in 1999 after 32 years of marriage. He was a partner at a Boston law firm and a former state judge. She had worked at International Business Machines Corp. for 27 years. They equally divided $1.4 million in assets, and the court ordered him to pay her annual alimony of $110,000 until her remarriage or the death of either.

In March 2008, Mr. Pierce retired from his law firm and cited this change of circumstance in a request to terminate the alimony. He said his income had already fallen to about $225,000 in 2007, about half its level at the time of the divorce. A probate court reduced the annual alimony obligation to $42,000 but refused to terminate it, arguing that Mr. Pierce had ample earning power and could find another job, such as teaching.
Mr. Pierce, now 67, argues that the court was telling him, in effect, that he couldn't retire. He appealed to the state's supreme court.

Ms. Pierce, meanwhile, left her $95,000-a-year fund-raiser job last summer, her lawyer said, after her territory was expanded to require more travel without additional pay. In briefs filed with the supreme court, Ms. Pierce said she had been pinched by the downturn and that her retirement funds were down almost 50%. Her lawyer, David Cherny, said that while Mr. Pierce's income had also fallen, there was still a financial disparity between the couple because she devoted more time to her family than her career during the marriage.

"She had given up a lot to this relationship," Mr. Cherny says, adding that it would be wrong to change a divorce agreement they'd already made.
Divorce agreements can get rewritten even decades later, as retired Boston engineer Mr. Taylor has learned.
In 2003, more than two decades after agreeing to end a 17-year marriage without alimony, Ms. Taylor was diagnosed with melanoma. She lost her publishing job when her employer of 38 years filed for bankruptcy protection. She'd recently surrendered her home to the bank and filed for personal bankruptcy to resolve $27,000 in medical and credit-card debts.
Mr. Taylor, meanwhile, had retired after 33 years working for the city of Boston, with an annual pension of $56,000.

In a September 2007 complaint filed in a state probate court, Ms. Taylor cited "changes in circumstances" and sued her former husband for support payments. She wrote that Mr. Taylor owned homes in Florida and Cape Cod and traveled to Europe.
In court, Mr. Taylor said he was sensitive to his former wife's plight, but that too much time had passed and that their divorce was final 25 years ago. His second wife, he said, had inherited the Cape Cod house from her father. Their trips were financed through home-swaps and reduced-fare tickets from his stepson, an airline employee.

In June 2008, a probate judge ordered Mr. Taylor to pay temporary alimony based on Ms. Taylor's "dire immediate need" and his "ability to pay." In its January final order, the court, citing Mr. Taylor's income from his pension, told Mr. Taylor to pay his ex-wife $400 per week for five years. The payment will eventually fall to about $250 a week for the rest of her life.

Virginia Connelly, Ms. Taylor's lawyer, says she can see how Mr. Taylor could find the situation unfair. But under Massachusetts law, she said, judges who want to keep a person off public services can turn to the ex-spouse.

In May, to seek relief from legal and other bills, Mr. Taylor declared personal bankruptcy. He is still responsible for supporting his ex-wife. "If she loses all her money, so what? She can just take me back to court," he says. "Somewhere along the line I should have peace of mind."

Servant culture 'killing families, feeding racism'

World's poor pay for west's feminism, says author. Middle-class families who hire cleaners and nannies so women are free to go out to work are contributing towards a new exploitative "servant economy", a leading American feminist claimed last night.

Middle-class families who hire cleaners and nannies so women are free to go out to work are contributing towards a new exploitative "servant economy", a leading American feminist claimed last night.

Barbara Ehrenreich, whose international bestseller Nickel and Dimed tells how she spent a year trying to earn a living from menial jobs in the United States, said the new "servant culture" was destroying families in the developing world and inculcating racism in children in the west.

She told the Edinburgh Book Festival that many of the benefits feminism had brought to middle-class women in the west had been paid for by the enslavement of poor migrant women.

"Imperialism used to extract the gold and other resources, now we are taking love from the poorer countries. Many of these women have to leave their own children behind to come and work as childminders."

Ehrenreich, whose new book, Global Women, examines what she claims is an unrecognised people trade, said: "We women in the rich countries work, so we need someone else to do the work at home and look after our children.

"Our children learn quickly in this servant economy that some people are more worthy than others. New hierarchies emerge. Because increasingly cleaning women are women of colour, so you imprint racism very early." But the main blame lies with men for their failure to properly share the burdens of the home, she argued.

Ehrenreich said no longer having to do your own housework had also "bred a callousness and solipsism in the people it served", and made them complacent in their privilege.

"In this way paid housework is more damaging in some respects than violence in films," she said. It encouraged a thinking that the socks we dropped would be mysteriously tidied away, and by extension that the pollution our factories created would just go away and did not matter.

"The ugly underside of this is that women are also lured here for cleaning or childminding jobs by traffickers and they end up in brothels."

The rise of the new servant economy could be directly traced to the mid-1980s, she said, when women in the west first began to enjoy the fruits of feminism. "At that point that the graph in which men, who had for the previous decade or so been taking on more domestic chores, flattens out. It is because men have not taken up their responsibilities at home that this demand for domestic help exploded.

"You can even see it in the advertising that is used for house cleaning services in America, some even say, 'We will save your marriage!'"

Feminism had badly failed these poor and migrant women, she insisted. "We thought entirely in terms of reforming men, which hasn't worked yet. Even in the west, feminism may have made great gains for middle-class women, but the other 70% who are still doing stereotypical female jobs have not seen much change."

Ehrenreich has been labelled an "intellectual pornographer" by rightwing groups in America, who are furious that Nickel and Dimed has been adopted on to university syllabuses. "They said I was an atheist who has dedicated her life to the destruction of the American family," she claimed.

But the real destruction was in developing countries, many of whose governments actively collude with the trade in domestic servants. "If you look at countries like Sri Lanka or the Philippines that these women have left behind, it has had a calamitous effect. Children are left to be looked after by the men, such that they do, who are mostly unemployed."

She said the governments of poor countries often used the money sent home by migrant women workers as a way to do nothing about poverty.

Family Law: Men Are Kicked in the Teeth

We cannot stop the attack on Iraq or Afghanistan. But we can stop the attack on families. As men, we can stand up and resist tyranny.

July 26, 2009

Brian's family was the last I had expected to break up. Brian and Gail had been married 24 years. They had six children ages 7-18 and were active in the pro-life movement. At elections, they were the only ones with a lawn sign for the Conservative party.
Brian, 46, ruggedly handsome and dishevelled, was a carpenter and bricklayer. He quit grad studies in city planning because he couldn't stand the politics.
Brian is a very rare person. He is genuine. In April, he stopped a man from beating a woman on a downtown roadway. Hundreds of passersby just stood by and gawked. Ironic, he stood up for a woman, and now is being crushed by feminist family law.
Recently I met Brian, and learned why he and Gail had moved away.

BRIAN'S STORY

It seems Brian had a mid-life crisis. He had fallen into a deep depression and couldn't work. Perhaps the stress of operating a small business for 20 years had caught up to him.
"Many times it was, if you don't get the job, you don't eat," he said.
After five months of depression, Gail secretly got a restraining order and a month later, she ordered him out of the house.
She told him she couldn't cope with his depression. She told the police she was "afraid of his temper."
While he waited in the police car handcuffed like a common thief, a cop said he should be thankful. She could have falsely accused him of assault and put him in prison for weeks.
In 24 years of marriage, Brian never hit Gail. Sure he had a temper and occasionally raised his voice. So did she. It was a normal part of family life. Gail had been "his best friend."
Brian forgives Gail and makes excuses for her. He championed causes that must have taken a toll on her. For example, they had received death threats for his defiance of a local biker gang.
But the biggest factor was a neighbor who had just split up, and filled Gail's head with feminist dogma. Gail told him: "I bet you never thought that sucky little Gail would become a strong independent woman."
This is how Communist-Satanist movements work, corrupting one person at a time. Whether its destroying one family or getting one more child on Ritalin, the cancer spreads from cell to cell.
They always operate behind the smokescreen of some "social ideal" but their real agenda is to divide and conquer and destroy.
Brian had always consulted Gail but she never took much interest in decision-making. Now she pretends to enjoy "calling the shots." She has become aggressive and abrasive.

COURT
In court, criminals get better treatment than Brian did for "having a temper." A husband and father, he was considered an enemy of society. He lost the fruits of a lifetime labor: his children and his home.
"It was all rubber-stamped," Brian said. "The lawyers and judge didn't give a damn. My lawyer said justice was just a word."
He was left with a few tools, clothes and books.
Tears welled up in Brian's eyes when he told the judge: "All I ever wanted was to be a knight in shining armor. Instead I'm Satan himself."
Alone in his apartment, he cried over the loss of his children: "the floodgates really opened up." During the school year, Brian looked after the children more than Gail who was a schoolteacher.
"I miss getting the children up in the morning, even when they are cranky," he says.
Gail's betrayal shocked Brian out of his depression. He still sees his children who seem to be managing. He is getting work, dating and trying to put his life back together.
The novelty of being an "independent woman" is beginning to wear off for Gail. She is overwhelmed with work and parenting, and the children say she is always yelling.

CRUEL HOAX
Women are being hoodwinked into thinking they want power. Power is the wrong kind of fuel for them; eventually their engines start to sputter. They need male love expressed as male power. A feminist with six children will have a hard time finding it.
Many people ask me what we can do about the New World Order. Make no mistake, domestic violence and family laws are the vanguard of the Communist NWO. The Rockefeller "think tanks" have ordained the destruction of the nuclear family by smashing paternal authority. The object is to foster isolation and dysfunction so we cannot resist servitude, and to decrease population. The protection of women is not the real agenda.
Where families are concerned, the totalitarian state has arrived. If a couple is overheard having an argument, a neighbor can phone the police who will take the husband away.
Opportunistic and naïve feminists, lawyers and politicians advance this evil agenda. There are  good people among them who could not be comfortable with this. We must ask them to reconsider.
I encourage people to form small groups and meet regularly for mutual support and action. (The NWO wants us to be isolated.) We should remind judges, the press and politicians that they have been subverted. We should demand changes in domestic violence and family laws. At election time, we should call politicians to task.
We cannot stop the attack on Iraq or Afghanistan. But we can stop the attack on families. As men, we can stand up and resist tyranny.

Kaun banega harass’d-pathi?

June 28, 2010

Kon banega harass’d-pathi? (Who wants to be a Harassed Husband)

Gone are the days when divorce was outlawed by most Indian communities. Now that the stigma has worn out, divorce rate of present century is soaring with an outrageous 350% rise in Kerala; most other states marking over 200% and Delhi been declared ‘The Divorce Capital’ as per various media reports. India is eagerly waiting for the 2010 census to see whether or not women beat the existing world record of filing divorce. The way Indian women outnumbered Americans in the number of women CEOs they outperformed in the matter of divorce as well. Previous census data shows 80-85% of divorces were filed by women where as only 66% of women instigated it in USA.

May be our legislators recognized this huge disparity and decided to maintain the social balance by proposing “irretrievably broken down marriage” as a ground for divorce; or else it could be our honorable power minister Sushil Kumar Shinde showing his power for his daughter Smriti Shinde. The same clause was proposed by the law commission way back in 1978 and several other law commission that came later also recommended it over and over again, the latest being 217th report in March 2009, but until now none of our minister’s daughter needed any divorce on this ground!

Most Indian women used to consider marriage as a ‘once in a life time’ activity, but now, what could have changed to twist the whole story? The BUMPER PRIZE! Yes the bumper prize that one could win if they break the marriage rather staying in the relationship. Various definitions of money like ‘alimony’, ‘maintenance’, ‘residence rights’, ‘child support’ etc seems to be more attractive to a fairly good number of women, regardless of their age, than immaterial things like ‘relationship’, ‘love’, ‘family’, ‘parenting’ etc. In order to achieve this ‘treasure’, all they need to do is to frame their husbands as ‘cruel’; and this is just a matter of making a local call.
One Delhi based businessman’s wife alleges even group sex with relatives and also claims that they have given 60 lakhs as dowry. Whether or not Muslim families in Delhi engage in those activities that are even new to liberal societies around the globe, is yet to be proven in the court of law!

Recently, a 65 year old man committed suicide in Taloja prison toilet after being convicted in a dowry harassment case filed by his wife! An average case in lower court would take around 5 years to get a verdict (not justice quite often). He wouldn’t have waited that long to hang himself unless he had strong confidence to prove his innocence. No sane person would think a man of that age would have fought for dowry from his wife.

Supreme Court Judge Deepak Verma while hearing a matrimonial case said “Married men should forget about their freedom”; in another case Justice Markandey Katju said “Do what the wife tells you and never question her authority; if wife says turn right, turn right and if she says turn left, then turn left”. If this is the attitude of our Apex court judges against men, what could this 65 year old man have heard from a lower court judge which led to suicide?

A couple of days ago Delhi high court Justice S N Dhingra ordered a husband to buy a house worth 18 lakhs for his wife in 30 days or else his bail will be cancelled and has to go jail. Here also dowry harassment case, IPC 498a, plays the major role. Those who are aware of the pattern of complaints coming in various NGOs across the nation, related to the misuse of these women centric laws, would consider the chances of criminal intimidation, blackmailing and extortion attempts which could have forced this guy to sign such an agreement.

In most of the cases when police arrest the husband and his entire family and take them to the station, the first thing that the cops do is to make them sign blank papers. It is not even a month old story that an 8 months old baby girl who was jailed in dowry harassment case died due to inappropriate medical assistance when she fall sick. Those who have never even seen the corridor of a police station until marriage would get scared of manhandling and succumb to whatever they are asked to do, to avoid all sorts of abuses and ill treatment.

Lawyers and women organizations including National Commission for Women say abuse of the legal system is woman’s right as they want fair settlement. Introduction of a new ground for divorce is going to accelerate the pace of abuse because at present the only threat for abusers in this extortion venture is not getting divorce until all the fabricated litigations are closed. The new clause will make this government sponsored legal terrorism fail proof. This is the era of Ayesha Siddiquies and the question what remains is, as what the title says, who is the next one to get harassed?
