The Delhi High Court Friday directed the Delhi police to ensure the safety of Ruby, a seventeen year old girl, who had approached the court for protection from her parents. The girl had eloped with her boyfriend earlier this year, following which she became pregnant. The boy, Ravi Soni, is now lodged in the jail following a rape case filed against him by the father of the girl. The father of the girl claimed that the girl was only fifteen, according to Indian law any act of sex, under sixteen years of age with or without consent of the victim is an offence of rape.
However, the Delhi Legal Services Authority, which is representing the case on girl’s behalf, produced before the court the dental records of the girl which prove that the girl is more than 17 years. The report was accepted by the court.
The court while observing that it is more a case of love affair between a young couple instead of a case of rape, suggested that the boy whose bail application was rejected by sessions court yesterday, prefer a fresh bail application. The court also asked DLSA to look into the matter and provide him legal assistance.
The court has directed the police to visit the house of the girl once a day to ensure about her safety. The court has also directed the police to escort the girl, who is presently living in Delhi, to her village, if she so demands.
