ANTICIPATORY BAIL -Many are misinformed (India)

Many people say filing of FIR or CC is must for anticipatory bail. That is crap. This is a constitutional bench judgement. Many people and advocates are misleading the public. WRONG ! Here it goes :

"Thirdly, the filing of a First Information Report is not a condition precedent to the exercise of the power under Section 438. The imminence of a likely arrest founded on a reasonable belief can be shown to exist even if an F.I.R. is not yet filed. [418 B-C]"

Read and understand the words - 'reason to believe'. People - Fight for your liberty. Don't listen to people who say 'you cant do this or that'. They are as good as the police scum. BEWARE - There are lots of jokers in this country !
